SJTRIDES - Ticketing Terms and Conditions

Terms 

Thank you for using the Saint John Transit Commission’s electronic ticketing application for mobile devices (the “SJTRides App” or the “App”). The SJTRides App is provided by the Saint John Transit Commission (“SJTC,” “we,” or “us”), with electronic ticketing services supplied by Masabi LLC (“Masabi”).

We encourage you (the “User”) to review these Terms carefully. These Terms govern the purchase and use of eTickets and passes through the SJTRides App for travel on any Saint John Transit service.

SJTC and/or Masabi may update these Terms at any time by posting revised versions on the Saint John Transit website and/or within the SJTRides App. Unless you are otherwise notified, such updates will not affect any Terms previously accepted by you when making a purchase through the App. Your continued use of the SJTRides App after notice of any changes constitutes your acceptance of the revised Terms.

By downloading and using the SJTRides App, you acknowledge and agree to be bound by these Terms.
 

App Services

The SJTRides App is provided to you free of charge on an “as‑is” basis. SJTC may discontinue or suspend operation or support of the SJTRides App or its associated services at any time. Should this occur, SJTC will make reasonable efforts to provide advance notice. If SJTC permanently ceases operation of the SJTRides App or its services, any remaining balance associated with unused eTickets or Passes at that time will be refunded.

SJTC may suspend your access to the SJTRides App, including the ability to purchase or use eTickets and Passes, at its sole discretion and for any reason. SJTC may also terminate your right to use the SJTRides App or any related services if you are found to be in violation of these Terms. If your rights to use the SJTRides App or its services are terminated, you must:

• Cease all activities authorized under these Terms, including any use of the SJTRides App or its services; and 

• Delete or remove the SJTRides App from all devices in your possession and immediately destroy all copies of the App.
 

Intellectual Property Rights

SJTC grants you a limited, non‑exclusive, non‑transferable right to download, install, and use the SJTRides App on your mobile device for the purposes of: (i) purchasing and displaying eTickets and Passes, and (ii) accessing transit information for your personal use only, and for no other purpose, all in accordance with these Terms.

All intellectual property rights in the SJTRides App and its associated services are owned by SJTC. You do not acquire any intellectual property rights in or to the SJTRides App or the Services, other than the limited right to use them as permitted under these Terms. You do not, and will not, own the SJTRides App or any information provided through it. The SJTRides App is licensed to SJTC by Masabi and is made available to you solely for personal, non‑commercial use.

You must not attempt to alter, modify, copy, transfer, or otherwise manipulate any eTicket or Pass, nor may you attempt to share or transfer an eTicket or Pass to any other user.
 

Operating System Requirements

SJTC and Masabi have made reasonable efforts to ensure that the SJTRides App operates effectively on compatible mobile devices. However, neither SJTC nor Masabi guarantees that the App will meet all of your travel needs or function accurately at all times.

The SJTRides App is currently supported on compatible Apple iOS and Android devices.
 

Data Charges and Access

The SJTRides App requires a properly configured and functional wireless data connection (cellular or Wi‑Fi) for initial installation and for making purchases. If you use the SJTRides App outside an area with Wi‑Fi, your agreement with your mobile service or network provider will apply.

You may incur data charges from your mobile service or network provider while accessing the SJTRides App, including roaming charges if you use the App outside your home region or country without disabling data roaming. By using the SJTRides App, you accept responsibility for any such charges. Purchased eTickets and Passes may be activated without an active data connection.

SJTC is not responsible for any connection issues you may experience. For this reason, you are encouraged to download, configure, and test the SJTRides App in advance of when you intend to use your eTickets or Passes, and to do so in an area with adequate network coverage. Please contact your mobile service or network provider if you require assistance configuring a data connection on your device.

It is your responsibility to ensure that your mobile device remains sufficiently charged to display your eTickets and Passes for the duration of your trip.
 

Communication

All questions, issues, complaints, notifications, and other communications should be directed to SJTC at [email protected] or by calling (506) 658‑4700. If we need to contact you, we will do so using the information provided by you as a registered User. Such communications may include technical or support information, as well as updates or notices regarding changes to the SJTRides App or its services. By using the SJTRides App, you consent to receiving these communications.
 

Mobile eTicketing

The security of your mobile device is your responsibility. If your device is lost or stolen, you may transfer any previously purchased eTickets or Passes by logging into the SJTRides App on another compatible device. Your eTickets and Passes must be clearly displayed on your mobile device screen when requested by the vehicle driver, any SJTC staff member, or local police. If an eTicket or Pass is damaged, altered, or illegible in any way, it will be considered invalid and a new one must be purchased. If the issue occurred through no fault of the User, you may request a refund for the unused eTicket or Pass.

By purchasing a mobile eTicket or Pass, you agree to fully cooperate with the vehicle driver, SJTC staff, or local police, and to present your mobile device and the eTicket or Pass details upon request. It is your responsibility to ensure that your mobile device is in good working condition and sufficiently charged to display your eTicket or Pass whenever required.

Your eTicket must be scanned on the onboard validator each time you board a Saint John Transit bus. If an onboard validator is unavailable, your eTicket or Pass must be clearly displayed on your mobile device screen for inspection by the vehicle driver, SJTC staff, or local police. You must retain your eTicket or Pass for the entire duration of your trip.

SJTC reserves the right to refuse travel if you fail to present a valid eTicket or Pass, or if the eTicket or Pass is being used on a lost or stolen device. SJTRides eTickets and Passes are non‑transferable and may only be used by the registered device user. Failure to present a valid eTicket or Pass constitutes fare evasion and may result in enforcement actions in accordance with SJTC policies, municipal by‑laws, and the laws of the Province of New Brunswick and Canada.

The price paid for an eTicket or Pass remains valid for the duration indicated on the eTicket or Pass. Any subsequent price changes will not affect SJTRides eTickets or Passes already purchased.
 

Discount Fares

Customers who qualify for approved discount fare programs (Child, Student, and Senior) may be eligible to purchase discounted SJTRides eTickets and Passes through the SJTRides App. Discounted eTickets and Passes may only be used by individuals who meet the eligibility requirements for the applicable program. Passengers may be required to present valid proof of eligibility (such as government‑issued photo identification) to the vehicle driver, any SJTC staff member, or local police upon request.

Unauthorized use of discounted fare programs, including failure to present valid proof of eligibility when requested, constitutes fare evasion. Such violations are subject to enforcement actions in accordance with Saint John Transit Commission policies, municipal by‑laws, and the laws of the Province of New Brunswick and Canada.
 

eTickets & Passes Expiration and Inactivity

Each eTicket and Pass includes an expiration date. Once an eTicket or Pass has expired, it is no longer valid and cannot be used as fare media. The expiration date for each item varies and is displayed on the original eTicket or Pass.
 

eTickets or Pass Loss and Damage

If an eTicket or Pass is damaged or becomes unreadable in any way, it is considered invalid and a new one must be purchased. If you delete the SJTRides App, all associated eTickets and Passes will also be deleted. If you reinstall the SJTRides App on the same device, your previously purchased eTickets and Passes will be restored to that device. eTickets and Passes cannot be printed, transferred, or otherwise reproduced. The User holds each eTicket and Pass at their own risk.

Release and Indemnity

The User hereby releases SJTC, the City of Saint John, Masabi, and their respective officers, employees, and agents from any and all loss, damage, or injury, whether known or unknown, arising out of or in any way connected with the use or performance of the SJTRides App, eTicket, or Pass. Neither SJTC, the City of Saint John, nor their respective officers, employees, or agents shall have any obligation or liability with respect to the User’s use of, or the performance of, the SJTRides App, eTicket, or Pass. The User’s sole and exclusive remedy from SJTC shall be the replacement of any defective eTicket or Pass.

The User agrees to indemnify, defend, protect, and hold harmless SJTC, the City of Saint John, Masabi, and their respective officers, employees, and agents from any and all liability for loss, damage, or injury to persons or property arising from or related to the SJTRides App, eTicket, or Pass.
 

SJTRides App Usage

By agreeing to these Terms, you are permitted to download a copy of the SJTRides App onto your mobile device and to view, use, and display the App and its Services on that device for personal use only. The SJTRides App is compatible with supported Apple iOS and Android devices.
 

SJTRides App Registration

The registered User is granted the right to use the SJTRides App and the Services as described in these Terms. The SJTRides App and the Services are non‑transferable. If you sell or otherwise transfer any device on which the SJTRides App is installed, you must remove the App from that device prior to completing the transfer.
 

SJTRides App Updates and Service Changes

From time to time, we may automatically update the SJTRides App and modify the Services to improve performance, enhance functionality, address security concerns, or reflect changes to operating systems. We may issue updates to the SJTRides App, and you may be unable to continue using the version installed on your device until the relevant update has been downloaded and installed. If an update is issued without disabling the earlier version on your device, we strongly recommend installing all available updates. SJTC is not liable for any errors, malfunctions, or issues that arise from continued use of outdated versions of the SJTRides App.

SJTC may suspend access to the purchase of eTickets and Passes through the SJTRides App. While we may do so for any reason, such suspensions typically occur when maintenance is being performed on the App or on supporting systems.

Payment

The prices displayed in the SJTRides App are listed in Canadian currency. If you choose to purchase an eTicket or Pass using a foreign credit or debit card, you are responsible for any applicable exchange rates. Please be aware that exchange rate fluctuations may affect the final amount charged for your eTicket or Pass, as well as any refunds or adjustments.
 

Cancellations and Refunds

SJTC eTickets and Passes are non‑refundable and non‑replaceable. However, refund requests may be considered on a case‑by‑case basis under certain conditions, including:

• Verified circumstances beyond the customer’s control (e.g., medical reasons, loss of employment, stolen property). 

• Lost or damaged fare media is non‑refundable.

Refunds may require 4–6 weeks for processing.
 

Statistical Data

By using the SJTRides App or any of its Services, you agree that SJTC may collect and use technical information obtained from the device software, hardware, and peripherals associated with the App. SJTC may also compile statistical information regarding ridership based on personal information received through the SJTRides App or its Services. This statistical information may be used to improve SJTC products and services and may be shared with SJTC employees, contractors, and/or Member Agencies. Such statistical information cannot be used to personally identify any individual.
 

External Website Responsibilities

The SJTRides App and its Services may contain links to independent third‑party websites that are not provided, controlled, or maintained by SJTC. These websites are not governed by these Terms. You are responsible for reviewing the privacy policies, terms of use, and services offered by any external sites you choose to access, and for assessing any associated risks.
 

Confidentiality of Information

Internet transmissions are never completely private or secure. Any message or information you send using the SJTRides App or its Services may be read or intercepted by others, even if a notice indicates that the transmission is encrypted.

It is your responsibility to keep your mobile device and access to the SJTRides App secure. We strongly recommend that you do not remove operating system restrictions or limitations on your device. Doing so may make your device vulnerable to malware, viruses, or other malicious programs, compromise built‑in security features, and prevent the SJTRides App from functioning properly. You must ensure that your device is protected by a suitable PIN, password, and/or biometric identification so that, if lost or stolen, your stored information cannot be accessed or used by others.

SJTC may obtain personal information from you when you submit comments, complete a survey, or subscribe to an email newsletter. This personal information may include your name, email address, phone number, street address, or similar details. SJTC and its contracted vendors do not sell, trade, rent, or otherwise disclose your personal information to third parties. SJTC may use your personal information to respond to comments, process transactions, contact you with information about SJTC or other transit services, and conduct research related to its products or services.

SJTC may also share information with third‑party service providers retained under contract or subcontract to support the operation of the SJTRides App. These services may include, but are not limited to, e‑commerce processing, software development, customer information management, responding to customer inquiries, conducting market research, processing transactions, and providing product or service support. These third‑party contractors may obtain, store, and/or process your personal information on their own systems. Some contractors may contact you directly using the information you have provided; they are required to identify themselves as representatives of SJTC. All such contractors are contractually obligated to maintain the confidentiality of your personal information.

SJTC is committed to protecting personal information collected through the SJTRides App against unauthorized access, use, or disclosure. Access to personal information is limited to employees and contractors who require it to perform their official duties or contracted services. These individuals are required to maintain confidentiality and may not disclose or use personal information except as permitted under these Terms.

SJTC has implemented security features throughout the SJTRides App to help prevent unauthorized access to personal information. However, despite these measures, the confidentiality of any communication or material transmitted to or from SJTC via the App or email cannot be guaranteed. When disclosing personal information, you should remain mindful that such information may be accessible to others and could be used in unauthorized ways.
